18 Months Too Long For Parole

The Administrative Court has reached a conclusion that an 18 month delay in a fresh Parole Board review was a breach of Article 5 ( 4 ) of the European Convention of Human Rights .

That no prisoner should be held any longer than is strictly necessary for the protection of the public and accordingly that setting a long date of 18 months was not justified in the circumstances .

Each case should be considered on its own merits . However mere conveneince of a review would not be a good reason for an 18 month review .

This case demonstrates that each case must be carefully handled by the probaiton service and delay caused by system deficiencies or practicalities will inevitably lead to a breach of aricle 5 ( 4 ) .

Steven Breeze's conviction has been quashed by the Full Court . This was despite an initial refusal by the Single Judge . An extensive investigation was able to deliver strong grounds which contributed to a view by the Court that the direcitons given by the Trial Judge were inadequate .
