The Lasting Power of Attorney – what is a Property & Affairs LPA?

A property and affairs Lasting Power of Attorney (LPA) is a legal document that allows someone (the Donor) to choose other persons who they trust (Attorneys) to make decisions on their behalf about their property and affairs but may for example be physically disabled.

The Donor may appoint an Attorney to manage their property and affairs while the Donor still has capacity to make decisions themselves. e.g paying bills or collecting benefits.

Or, alternatively the Donor may include a restriction that the LPA can only be used at a time in the future when the Donor lacks capacity to make decisions for themselves. e.g onset of dementia or brain injury. The LPA can only be used once registered with the OPG.

If the Donor wishes to make provision for Personal Welfare, a separate Welfare LPA must be used.
