False Memory Case earns leave 6.10.08

Michael Eardley has finally been given leave to appeal at the Court of Appeal Criminal Division . The case was originally refused leave to appeal , however the team at Jordans did not lose faith and the case led by Barrister Mark Barlow of Garden Court North Chambers Manchester persuaded the Court to give leave .

At the appeal to be heard in due course the Court are likely to specifically address the issues of False memory and delay in historical cases . We will rely onthe considerable talents of Professor Martin Conway a leading expert in the field of False memory syndrome .

The Appeal will be heard at a later date .

Mark Newby , Mr Eardley's Solicitor said :

" Whilst we cannot fight every single appeal refused by the single judge for obvious reasons , there are a number of cases in which we are so convinced that something must be done that we will leave no stone unturned . This case demonstrates that no matter how long it can take perseverence counts . We hope these efforts will now be rewarded in the full review by the Court of Appeal "

Steven Breeze's conviction has been quashed by the Full Court . This was despite an initial refusal by the Single Judge . An extensive investigation was able to deliver strong grounds which contributed to a view by the Court that the direcitons given by the Trial Judge were inadequate .
