Law on Doli Incopax clarified

The Case of H was heard on 29th January 2010 and the court took the opportunity to clarify the arguments over the application of doli incopax to historical cases .

H was convicted at Sheffield Crown Court Before HHJ Keene in 2005 .

The case raised an interesting argument over the issue of Doli Incopax and the court confirmed that the principle still applies to a historical case and allegations from a time when the doctirne still was good law before it was abolished .

As a result that conviction and certain others were quashed , however regretably not all counts were so the appellant must continue his fight to the CCRC .
